What Types of Requirements Does Fastbolt Comply With?

New Forced Labor Prevention

Effective June 21, 2022, the Uyghur Forced Labor Prevention Act establishes a rebuttable presumption that any goods, wares, articles, and/or merchandise mined, produced or manufactured wholly or in part in China’s Xinjiang region made with forced labor and therefore barred from entry into the U.S. under Section 307 of the Tariff Act of 1930. That new law is designed to counter human rights abuses against the Uyghur minority.

Restriction of Hazardous Substances (RoHS)

The buyer will require suppliers and their downstream supply chain affiliates to comply with the rules and regulations as set forth in the European Union Directive 2011/65/EU EEE (Electrical and Electronic Equipment). Parts or materials received after 1/2/13 will be subject to verification of conformance. 

Registration, Evaluation, Authorisation and Restriction of Chemicals (REACH) (EC No. 1907/2006)

This European Chemicals Agency regulation outlines the requirements for manufacturers or distributors of products that are shipping into the European Economic Area (EEA) and or from which may contain Substances of Very High Concern (SVHC), that have been defined and identified to pose health and safety issues, to make available for those products’ specific material and chemical compositional data.

Conflict Minerals

In accordance with Dodd Frank section 1502 and 13P the buyer, as a distributor of military and commercial fasteners and electromechanical components, will maintain a strict “supplier chain of evidence” with respect to parts purchased, to ensure that no parts or materials received will have been mined from the Democratic Republic of the Congo (DRC) or any associated countries.

TSCA (Toxic Substance Control Act)

The Toxic Substances Control Act of 1976 (TSCA) regulates the manufacture, import, distribution, use, release, and disposal of new and existing chemicals in US commerce. 

On January 6th, 2021, the US Environmental Protection Agency (EPA) Office of Pollution Protection and Toxics (OPPT) published the final rules for Section 6(H) of the TSCA.

NAS 412 Foreign Object Debris (FOD) Prevention

AS9100 requires an organization to have provision for the removal and prevention of Foreign Objects. NAS 412 is a National Aerospace Standard (NAS) developed and published through the Aerospace Industries Association (AIA).

International Traffic & Arms Regulation

In accordance with the Directorate of Defense Trade Controls parts 120 and 130. 

ITAR regulations dictate that information and material pertaining to defense and military-related technologies (for items listed on the U.S. Munitions List) may only be shared with U.S. Persons unless authorization from the Department of State is received or a special exemption is used.

DFARS 252.225-7009 (BERRY AMENDMENT)

Reference: “Restriction on Acquisition of Certain Articles containing Specialty Metals” (June 2012)

When this clause is stated in a contract or purchase order the Buyer will require suppliers of the raw materials or finished parts to provide documented evidence all the materials used in the manufacture of the supplied parts were melted in the USA or a “Qualifying Country” per 10 U.S.C. 2533(b) “Specialty Metals.” 

California Proposition 65

The California proposition, Prop 65, protects the state’s drinking water sources from being contaminated with chemicals known to cause cancer, birth defects, or other reproductive harm, and requires businesses to inform Californians about exposures to such chemicals. To market products in California, businesses must put the appropriate warning label on their products which states the product may contain certain chemicals that could lead to birth defects, cancers, or reproductive harm due to exposure.
